Terms of Service

The short version. You buy faxes, not a subscription. One fax sends up to 10 pages. Faxes you buy never expire. If a fax fails to arrive, you get the fax back.
1. This agreement
These terms are between you and Poznyak & Co. LLC, a New York limited liability company trading as Softery. They govern your use of FaxGo for iOS. By using the app you accept them. If you do not accept them, do not use the app.
2. What FaxGo does
FaxGo scans documents with your phone camera, or imports them from Photos and Files, and sends them as faxes over the public telephone network through a licensed carrier. FaxGo sends faxes. It does not receive them, and it does not give you a fax number of your own.
3. Faxes and how they are counted
- One fax is one successful transmission of up to 10 pages to one number.
- A document longer than 10 pages uses more than one fax. The app tells you exactly how many before you press Send, never after.
- New installations receive 3 free faxes of up to 3 pages each, granted once per account.
- Faxes you buy never expire, and we will not take them away for inactivity.
- Faxes are a licence to use the service. They are not money, not a stored value account, not redeemable for cash, and cannot be sold or transferred to another person.
- Your balance is held in your FaxGo account on our servers and is linked to your Apple ID, so it follows you to a new device signed in to the same Apple ID.
4. Buying and refunds
Fax packs are sold by Apple through the App Store, and Apple charges your Apple ID at the price shown at the time of purchase. There is no subscription and nothing renews automatically.
Because Apple is the seller, refunds are handled by Apple, not by us. Request one at reportaproblem.apple.com. If Apple grants a refund, the faxes from that purchase are removed from your balance, which can leave the balance negative if you already used them.
5. Delivery is not guaranteed
Fax runs over the ordinary telephone network and depends on the machine at the other end. A fax can fail because the line is busy, because nobody answers, because the number belongs to a voice line rather than a fax machine, or because the receiving machine drops the call.
If a fax fails, the fax is returned to your balance automatically, and the app shows you the reason in plain language. What we cannot do is promise that any particular fax will arrive, or arrive by a particular time.
Do not use FaxGo for emergencies, and do not use it where a missed or late document causes serious harm. Sending to the wrong number is not reversible: once a fax is transmitted we cannot recall it.
6. What you may not send
You agree not to use FaxGo to send:
- unsolicited advertising. In the United States, sending an unsolicited advertisement by fax is illegal under the Telephone Consumer Protection Act and the Junk Fax Prevention Act, and penalties fall on the sender.
- anything unlawful, fraudulent, threatening, harassing, or defamatory,
- material you have no right to send, including someone else's confidential documents,
- content that infringes copyright or another person's rights,
- anything designed to disrupt a recipient, such as repeated or automated bulk sending.
You are responsible for what you send and for having the right to send it to that number. If we have good reason to believe the service is being used this way, we may suspend or close the account without refund.
7. Your documents
Your documents stay yours. We claim no rights over them. We do not keep a copy after a fax is sent, which is explained in the Privacy Policy. A fax is not an encrypted channel, so consider that before sending highly sensitive material.
8. Fair use
To protect the service against abuse there is a daily page limit per account. Ordinary use will never reach it. If you have a legitimate need for higher volume, write to us.
9. Availability and changes
We aim to keep FaxGo running, but we do not promise uninterrupted service. We may change or discontinue features. If we discontinue the service entirely, we will give notice in the app and provide a way to use or be compensated for any faxes you have already paid for.
We may update these terms. The date at the top of this page shows when they last changed, and continuing to use the app after a change means you accept it.
10. Warranties and liability
The app is provided "as is", without warranties of any kind to the fullest extent the law allows, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent the law allows, our total liability to you for any claim connected with FaxGo is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost profits, lost business, or the consequences of a document arriving late, not arriving, or arriving at the wrong number.
Some jurisdictions do not allow these limits, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
11. Ending the agreement
You may stop using FaxGo at any time by deleting the app, and you may ask us to delete your account by writing to support. Deleting the account forfeits any unused faxes. We may suspend or close an account that breaks section 6.
12. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. The courts of New York have exclusive jurisdiction, except that either party may seek relief in small claims court.
